Beyond Forms — Strategy That Defines Your Future

We approach each case as an individual plan, built to achieve long-term results, avoid costly missteps, and safeguard your professional and personal journey in the United States.

Extraordinary Ability Visa

U.S. immigration law recognizes that innovation and achievement drive progress.

To attract leaders and experts from around the world, it offers special immigration pathways for individuals with extraordinary ability or exceptional contributions in their fields.

At The Luo Law Office, we help accomplished professionals, researchers, entrepreneurs, and creatives present their work in a way that meets these high standards with clarity and strength.

Extraordinary Ability Visas (O-1 and EB-1A)

Foreign nationals who have reached the top of their fields in science, education, business, athletics, or the arts may qualify for one of two categories:

O-1 nonimmigrant visa – for individuals who wish to work in the United States temporarily.

To qualify, you must show evidence of sustained national or international recognition for your achievements. While a major award such as a Nobel Prize, Pulitzer, Oscar, or Olympic Medal may be sufficient, most applicants demonstrate their standing through a combination of other accomplishments, such as:

EB-1A immigrant visa – for individuals seeking permanent residence.

Receiving nationally or internationally recognized awards for excellence

Membership in associations that require outstanding achievement

Published material about your work in professional or major media outlets

Serving as a judge of the work of others

Making original contributions of major significance in your field

Authoring scholarly or widely cited publications

Exhibiting or showcasing your work publicly

Holding a leading or critical role in a distinguished organization

Earning a high level of compensation for your expertise

Demonstrating commercial success in the performing arts

National Interest Waiver (NIW)

For individuals whose work substantially benefits the United States, the EB-2 National Interest Waiver provides another path to permanent residence.

Unlike most employment-based categories, the NIW allows you to self-petition without a U.S. employer or Labor Certification, if your contributions are deemed to serve the national interest.

Our Approach

Extraordinary ability and NIW cases are built on evidence — but even more on strategy and storytelling.

We take time to understand the depth of your achievements, the impact of your work, and how it fits within U.S. immigration criteria.

Our role is to help you translate complex professional accomplishments into clear, persuasive legal arguments, supported by strong documentation, expert reference letters, and cohesive presentation. Every detail matters. We work with you to ensure that your case reflects both the substance and significance of your career — and positions you for success.

Success Cases

Prior results do not guarantee a similar outcome. Every case depends on its specific facts and circumstances. Case descriptions have been anonymized to protect client confidentiality.

EB-1A — Commercial Entertainer

Young entertainer with no overseas performance experience and limited international recognition. We transformed a primarily domestic record into a cohesive case built on original contributions, leading roles, commercial success, industry recognition, and expert support.

Outcome: Approved.

EB-1A — Investment Management Professional

Without traditional academic credentials or metrics, the applicant’s achievements did not fit a conventional EB-1A profile. We translated commercial and professional success into persuasive evidence of original contributions, industry impact, leadership, and sustained recognition.

Outcome: Approved.

EB-1A — Multidisciplinary Entrepreneur

Achievements across multiple industries created an unclear field of expertise and a fragmented record. We identified the unifying professional strength, distinguished the applicant’s individual contributions, and built a coherent case around leadership and cross-industry impact.

Outcome: Approved.

NIW — Biomedical Researcher Across Multiple Projects

The applicant’s laboratory research spanned multiple projects, leaving the overall impact and individual contributions unclear. We identified the scientific value and the applicant’s role in each project, then unified the record around a focused endeavor with practical and national importance.

Outcome: Approved without RFE.

NIW — Researcher With Fewer Than 20 Citations

With few publications and fewer than 20 citations, the applicant lacked strong traditional academic metrics. We repositioned the case around a forward-looking proposed endeavor, emphasizing its emerging importance, practical applications, and the applicant’s ability to advance the work.

Outcome: Approved without RFE.
